To protect your Mallory Harbor property investment, regular drive-by inspections are scheduled by the contracted property management company. Any property, whose external maintenance level is not in compliance with the
Mallory Harbor Rules And Regulations, is issued a Property Violation.
The violation consists of a letter sent to the homeowner describing why the violation was issued and the resolution the homeowner is expected to take. Note that MHB board members provide oversight to the process, but do not issue violations directly to home owners.
This is how the violation process is administered by the property manager.
- First violation – the home owner is given a period of 30 days to bring their home into compliance. If the home owner complies, then the violation is closed with no further action and no cost to the home owner. In case of extenuating circumstances, the home owner has the option to call the property management company and explain their situation.
- Second violation - If the first violation is not corrected within the 30 day period a 2nd violation is issued giving the home owner an additional 21 days to comply.
- One time Letter - If the 2nd violation is not corrected in the 21 day period, a final violation is issued in the form of a “one time letter” advising the homeowner that their violation will be sent to the Mallory Harbor compliance committee.
- Compliance hearing - A hearing to appear before the Compliance Committee will be set and a 14 day notice will be sent to the homeowner. The homeowner still has an opportunity to comply prior to the hearing.
- Attorney Collection fees. At the hearing, the compliance committee will decide if the violation is valid. If the violation is voted upon as valid, the homeowner can be fined $25 per day up to $1000 until the violation is resolved. This fine will be placed on the account ledger.
If the fine is not paid after 60 days, the account is sent for collection to an Attorney retained by MHB. In addition to the overdue fine, collection fees will charged to the homeowner by the attorney with an increased risk of foreclosure against the property. All charges stay with the property if not collected and must be paid prior to selling the property.
